Indiana Construction Accident Lawyer Wins Supreme Court Case

We are pleased to report the unanimous Indiana Supreme Court victory in a case John P. Daly, Jr. recently represented, Ryan v. TCI Architects/Engineers.

This case is the first in the country to establish that the Design Build Institute of America Form 530 contract creates a duty on behalf of the general contractor for the safety of everyone on the project. Most importantly, that duty extends to all construction workers on the project, including subcontractors.

In this case, Mr. Ryan, a member of the sheetmetal workers union, was injured when he was given a ladder that was too short for the task he was assigned to do — meaning there was not proper equipment available to him to take necessary precautions for safety.

Because this contract is being used in many projects throughout the country, a victory for Indiana workers is a victory for workers everywhere. We’d like to extend a special thank-you to Bob Brown, who helped with the briefs on behalf of the Indiana Trial Lawyers Association.
