A victim and his or her family can face many legal challenges when filing a claim or lawsuit. For example, the circumstances of the accident may indicate that multiple parties were liable or negligent. In addition, the worker’s injury will dictate whether he or she will be able to return to work, which will affect workers’ compensation benefits. Some injuries warrant a personal injury lawsuit.

In this difficult time, you need the help of our personal injury attorneys in Indianapolis, IN, who know the system and will fight for you and your family. We can help clients in Indianapolis, Bloomington, Kokomo, surrounding communities, and throughout the state.

Have You Suffered a Life-Changing Accident at Work?

If you were injured at work, it is important to speak with a lawyer who focuses on workers’ compensation and personal injury law. Injuries that affect your ability to work can permanently compromise your quality of life due to strained finances, physical disability, and other factors.

Whether you pursue compensation through a workers’ compensation claim or personal injury lawsuit, you need a lawyer who will advocate on your behalf and obtain an award that will cover the true extent of your losses. That means accounting for immediate losses as well as those that have permanently affected you.

Some of the common types of life-changing injuries that workers suffer include:

  • Loss of limb
  • Burns
  • Paralysis
  • Disfigurement and scarring
  • Traumatic brain injury

Let’s Discuss Your Case

Taking legal action can be intimidating, but it is important to cover your losses and protect your future. By contacting our personal injury lawyers, injured workers can focus on healing while we handle the claim. We can review the circumstances that led to your accident, determine if a third party was at fault, and assist you in filing a worker’s comp claim or filing a personal injury suit.

Should I File a Personal Injury or Workers’ Compensation Claim?

If you were injured at work, you generally have one of two options available when it comes to pursuing compensation: file a workers’ comp claim or file a personal injury lawsuit against a third party.

Option 1: File a Workers’ Compensation Claim

Workers’ compensation benefits provide workers with compensation for lost wages and medical bills when they are injured on the job. Under state law, employers are required to have workers’ compensation insurance to cover these types of claims.

Requirements of a Workers’ Compensation Claim

In order to file a successful workers’ comp claim, employees must:

  • Show that they were injured on the job while performing work duties
  • Show that they have suffered a traumatic accident, such as the loss of a limb, or an occupational injury, such as damage caused by repetitive motion
  • Notify their employer within 30 days
  • Undergo medical care as soon as possible to document the extent of damage

What Do Workers’ Compensation Benefits Cover?

In Indiana, injured workers can expect to receive the following benefits:

  • Two-thirds of their average weekly wage; this income is provided for the amount of time recommended by the employer-approved physician
  • Coverage for medical care by the employer-approved physician
  • Reimbursement for approved expenses such as medication

When to Contact an Attorney

The Workers’ Compensation Board of Indiana handles all worker’s comp claims and appeals. Our lawyers have worked with this agency for many years and can help clients collect the restitution they need to move on with their lives. We encourage injured workers to contact us when:

  • They are preparing to file a workers’ compensation claim
  • A claim is denied
  • The benefits don’t cover the losses caused by the accident

Option 2: File a Personal Injury Lawsuit against a Third Party

If someone other than an employer or coworker caused the accident, it may be advisable to file a personal injury lawsuit against a third party. In these cases, we typically seek damages from the negligent party’s insurance company. In cases of extreme negligence, the at-fault party and their insurance company may be responsible for paying damages.

Requirements of a Personal Injury Claim

To have grounds for a personal injury lawsuit, injured workers must:

  • Have suffered harm due to the negligent or reckless actions of a third party
  • Show evidence that the other person or party caused the accident and is liable for damages
  • File a personal injury or wrongful death claim within two years of the accident or death

Types of Personal Injury Damages

Damages in personal injury cases cover emotional losses in addition to physical losses, such as medical bills and lost wages. Damages for pain and suffering consider how losses such as disfigurement, mental anguish, loss of convenience, chronic pain, and so many others affect your quality of life. These damages are intended to compensate victims for the emotional impact of the accident.

In seeking a favorable settlement, a careful examination of all medical and financial factors that will eventually affect the future of the injured person and his or her family is crucial. If you have suffered a personal injury in a construction accident or some other work injury, we consider some of the following questions:

  • Have you been seriously injured or has a loved one died unnecessarily?
  • Did the accident result in paralysis?
  • Are you eligible for workers’ compensation?
  • Did another person or party’s negligence play a role in the accident?

When to Contact an Attorney

If you have suffered a work injury, particularly one in which fault can be attributed to a third party, contact our personal injury lawyers. There are different scenarios in which a personal injury lawsuit should be filed when an employee is injured.

For example, employees who drive as a part of their profession are at risk of being involved in a car accident. If delivery drivers, truckers, or other workers are involved in an accident that was caused by the negligent actions of another driver, they can file a personal injury lawsuit.

Another common example includes workers who are injured by defective products while on the job. In this case, our personal injury lawyers can file a lawsuit against the designer, manufacturer, or seller of the defective product.
